SEC opens hearing to adjust advertising criteria of ICO portals and ICO issuers in the section on warnings of risks in investing in “digital tokens”

On September 16, 2567, the SEC (Securities and Exchange Commission of Thailand) opened a public consultation on amendments to the advertising regulations for digital token offering platform providers (ICO portals) and for digital token issuers (ICO issuers), specifically regarding risk warnings for investing in digital tokens. These amendments aim to help investors understand the risks and limitations before making investment decisions.

According to the Securities and Exchange Commission (SEC), regulations regarding advertising by ICO portals and ICO issuers require investment risk warnings. However, past instances have shown advertisements lacking such warnings and clear guidelines. Therefore, the SEC is proposing to revise these regulations to ensure that ICO portals and ICO issuers provide appropriate and standardized warnings, along with clearer methods for presenting investment risk warnings. This aims to help investors in digital tokens better understand the risks and limitations before deciding to use their services or invest in them.

The SEC (Securities and Exchange Commission of Thailand) is therefore seeking public comments on the principles and draft regulations regarding advertising, specifically concerning risk warnings for investment in digital tokens. The consultation document on the principles and related draft regulations has been published on the SEC website : https://www.sec.or.th/TH/Pages/PB_Detail.aspx?SECID=1017 and the central legal system : https://law.go.th/listeningDetail?survey_id=NDM0M0RHQV9MQVdfRlJPTlRFTkQ=. Interested parties and stakeholders can submit their comments via the website or by email to [email protected] or [email protected] until October 16, 2567.
