The statement indicates that, as previously announced by the National Anti-Corruption Commission (NACC), progress has been made in the investigation into allegations against Mr. Pita Limjaroenrat, during his time as a Member of Parliament for the Move Forward Party, and 44 others, regarding the proposal of the draft amendment to the Criminal Code (No. ...) B.E. .... The NACC stated that the investigation file would be completed and submitted to the NACC for consideration by December 2568.
Office of the NACC I would like to make a statement regarding this matter: After the investigative committee concluded its fact-finding investigation and was in the process of submitting the investigation file to the National Anti-Corruption Commission (NACC) since approximately mid-2568, the 44 accused subsequently submitted letters of objection to the investigative committee and other similar complaints that must be considered along with the decision on the fact-finding file.
Therefore, the investigating committee needed time to examine and analyze the facts and legal aspects before submitting their findings to the National Anti-Corruption Commission (NACC) for consideration. In addition, all 44 accused individuals requested to provide further verbal clarifications and defenses after having already submitted written explanations. The investigating committee, considering the interest of justice, granted all accused individuals who wished to do so the opportunity to verbally refute the allegations before the committee.
This necessitated a thorough and careful review of each accused's explanations and rebuttals. Once this process was complete, the investigation file was presented to the National Anti-Corruption Commission (NACC) for consideration today.

who jointly proposed a draft amendment to the Criminal Code (No. .. ) B.E. …. which contains content that is contrary to or inconsistent with the Constitution and seriously violates ethical standards according to the Constitution of the Kingdom of Thailand, Section 219, in conjunction with the Act on Prevention and Suppression of Corruption B.E. 2561, Section 28 (1).
The intention is to undermine the protection of the monarchy by using the legislative process to propose such a bill, which disregards and fails to uphold the democratic system with the King as head of state, as enshrined in the Constitution of the Kingdom of Thailand. Furthermore, it fails to safeguard the monarchy and is an act that damages the dignity of the position held.
Such actions erode and undermine the institution of the monarchy and cause widespread and serious damage to the nation. Furthermore, the amendment of the aforementioned Act has been incorporated into a campaign policy. The actions of Mr. Pita Limjaroenrat, who initiated and signed the motion to amend the draft Act, are deeply concerning.
With 43 other signatories to the proposed motion, bringing the total number of proponents to 44, the facts cannot be separated or explained to show that the actions of each accused were not coordinated in proposing the motion or that they did not act together. Furthermore, each accused person did not provide a clear explanation of their individual actions in proposing the motion. Therefore, the actions of all 44 accused were carried out with a common intent, in accordance with the Constitutional Court's ruling No. 3/2567 dated January 31, 2567.
The National Anti-Corruption Commission (NACC) has considered the content of the draft amendment to the Criminal Code as proposed by the 44 accused, along with their various conduct, and has concluded that, although the right to propose amendments to laws is a right of members of parliament who jointly sign a petition to propose legislation,
However, it is necessary to consider whether the content of the proposed draft violates any provisions of the constitution or contains inappropriate content in any way.

The aforementioned actions demonstrate a lack of adherence to and preservation of the constitutional monarchy and democratic system of government in the Kingdom of Thailand. The actions of all 44 accused therefore constitute a serious violation of ethical standards, based on their failure to uphold and maintain the constitutional monarchy and democratic system.
The constitutional monarchy under the Kingdom of Thailand, with the King as head of state, is based on the principle of failing to protect the institution of the monarchy, independence, sovereignty, territorial integrity and areas over which Thailand has sovereign rights, national honor and interests, state security, and public order.
And any act that causes damage to the dignity of the position, according to the ethical standards of judges of the Constitutional Court and those holding positions in independent organizations, including the Auditor General and the heads of administrative units of the Constitutional Court and independent organizations, B.E. 2561, Clauses 5, 6, 17, in conjunction with Clauses 3 and 27.
The meeting resolved to submit the matter and its opinions to the Supreme Court for consideration and a ruling on whether the actions of the 44 accused constitute a serious violation of ethical standards within thirty days from the date of the resolution.
