The Constitutional Court has accepted the case for review regarding the Emergency Decree authorizing a 4 billion baht loan for energy relief and transition. The Cabinet has been ordered to prepare a statement and submit copies of relevant documents within 7 days of receiving the letter.
18 May 2569 The Constitutional Court has accepted a petition requesting a ruling on whether the Emergency Decree authorizing the Ministry of Finance to borrow money to address the energy crisis and facilitate the country's energy transition in 2569 is in accordance with the Constitution. Article 172, paragraph one: Following the submission of an opinion by 133 Members of Parliament, which is no less than one-fifth of the total number of members of the House of Representatives, to the Speaker of the House of Representatives stating that the Emergency Decree on Borrowing is not in accordance with Article 172, paragraph one of the Constitution, the Speaker, as the petitioner, forwarded this opinion to the Constitutional Court for consideration and ruling.
The Constitutional Court, having considered the facts and supporting documents in the petition, has issued an order accepting the petition for consideration and ruling. The petitioner has been notified of this decision. For the benefit of the proceedings, the Cabinet is instructed to prepare a statement addressing the issues specified by the Constitutional Court and to submit copies of relevant documents to the Constitutional Court within 7 days of receiving this letter.
Reporters said that today's decision was made by a small panel considering whether to accept or reject the petition. The next meeting of the full nine-judge panel of the Constitutional Court will be held on June 4, 2026. After accepting the petition, the court, according to its procedure, must make a ruling within 60 days.
